Yes.Fit wants to use your Instagram, Facebook and Twitter content (“Content”) on other channels we control, our service providers or our customers.

1. By responding to our message with the hashtag(s) #tryingtogetmyfittogether #yesfitfam or uploading through our Gallery, you confirm and warrant to us the following:
2. Your age. You are over 18 (eighteen) years old.
3. Your Content. Your Content relates to Yes.Fit. You confirm the Content is not defamatory, deceptive, malicious or discriminatory, does not infringe third parties’ intellectual property or other rights and is compliant with applicable law. Your Content does not contain confidential information.
4. Content Standards. You will not submit Content that is: hateful, threatening, racist or pornographic; related to alcohol, drugs, tobacco or medicine; incites violence; encourages criminal conduct; contains nudity or violence or is otherwise offensive, unlawful, or of an indecent, obscene or menacing character. You will not submit Content that intimidates, insults or harasses any person. Your Content does not (and will not) contain commercial communications, spam or advertising content.
5. You have the rights to give these permissions. You possess all rights necessary to grant these permissions (including intellectual property rights in your content and permissions from any people appearing in it). You have not and will not commit any acts that could restrict or prevent you from giving these rights to Yes.Fit.
6. You consent to the use of your Content. You grant Yes.Fit a non-exclusive, assignable, sublicensable, perpetual, royalty-free permission to use the Content throughout the world in all and any media. This includes non-digital channels such as posters and printed publications as well as digital channels such as our websites and social media accounts (and may include channels owned or controlled by our customers such as retailer websites).
7. We have control over how we use your Content. Yes.Fit may (but is not obligated to) use your Content, and it may use, edit, alter or combine your Content with other materials of any kind. You accept that you do not have approval rights over Yes.Fit’s specific Content usage.
8. Indemnity and release. Yes.Fit can use your Content without having to pay any fees or infringing any rights. You release, discharge and hold Yes.Fit’s licensees, assigns, and it harmless from and against any and all claims, damages, liabilities, costs and expenses arising out of a breach of these warranties for Yes.Fit’s use of the Content, and indemnify it against any damages, attorneys’ fees or costs that may arise in this respect.
9. Limitation of liability. Yes.Fit is not liable to you for any of the following that may arise out of or in connection with its use of the Content (whether arising in tort, contract or otherwise): (i) any reduction in the value of the Content; (ii) any loss of profits, sales, business, revenue, or anticipated savings; (iii) loss or interruption of data or content; (iv) loss of business opportunity, goodwill or reputation; or (iv) any indirect or consequential loss or damage.

If you change your mind about Yes.Fit’s use of your Content or are a trademark / copyright owner and you believe a user’s Content is in breach of these rights, please contact us on socialmedia@yes.fit. Please include enough information so we can identify the relevant Content and (if applicable) the ownership thereof.

We do not control and are not responsible for the use of Content by third parties on sites outside of our control. If you require the removal of Content from third party sites outside our control you should contact that site directly.
